Dog Charges Woman While She Walked Her Dog

Case Description
A woman who was walking her dog in Osterville, MA, passed by a house whose owners forgot to put the “electric fence” collar on their dog before letting him out the front door. So, their dog was able to leave their property. While growling and barking, their dog charged this woman causing her to fall to the ground while she attempted to prevent their dog from attacking her dog. The dog owner observed the woman lying in the street, and handed her the leash for her dog and watched her hobble home.
Legal Issues
As a result of the dog owner’s negligence, the woman sustained serious injuries including a right femoral head fracture and a left non-displaced distal radius fracture. She was admitted to Cape Cod Hosital and underwent surgical intervention followed by in-home occupational and physical therapy.
Outcome
A settlement in the amount of $300,000 was awarded.
