Husband & Wife Trip and Fall on Defective Sidewalk

Case Description 

A wife was assisting her husband into a rehabilitation facility when he was caused to trip and fall due to an uneven and defective sidewalk. In the process of falling over, he knocked his wife over. She attempted to brace herself with her left hand, and in the process injured her left wrist, and suffered a displaced and angulated left distal fracture.

Legal Issues

The wife underwent a surgical procedure to repair the wrist, but remained in pain afterwards due to a surgical screw impinging a tendon in her left wrist. She had surgery to back off the screw, which caused her to be totally disabled for a period of time and unable to fend for herself or to assist her husband while she recuperated. She also needed continued assistance for herself and her disabled husband until she recovered from the screw removal surgery. During her recovery, she was unable to drive a car and relied on five different individuals to complete a variety of task including: preparing/serving meals; dispensing medication to her husband; assisting her husband with getting out of bed; dressing and grooming him; bathroom assistance; grocery shopping; picking up prescriptions at the pharmacy; household cleaning; laundry; and trash.

Outcome

A settlement in the amount of $225,000 was awarded.
